Perdebatan panjang terkait kepemilikan benda benda bersejarah antara mantan negara kolonial dengan koloninya acap kali luput dari perhatian kita. Padahal, sejak tahun 1840 setelah pendudukan Prancis berakhir, di dalam kongres Vienna, perhatian dunia sudah terarah kepada isu pengembalian benda-benda bersejarah kepada pemilik aslinya di negara asal.

Tren penjajahan yang dilakukan pada rentang waktu penjelajahan dunia baru hingga setelah perang dunia kedua usai memang tidak meninggalkan sedikit 'korban'. Tren yang terbukti cukup dibanggakan oleh negara kolonial kala itu, terlihat dari penyelenggaraan pameran kolonial yang dibangga-banggakan di paris, adalah memamerkan produk-produk hasil penjajahan. Baik itu dalam bentuk budak, hasil alamnya, hasil taninya atau bahkan benda-benda bersejarah yang diambil dari koloni masing-masing negara kolonial.

Perbudakan, politik adu domba, hingga perampasan identitas suatu masyarakat merupakan salah satu hasil dari tren penjajahan. Perampasan Identitas yang dimaksud disini salah satunya berbentuk pengambilan benda-benda bersejarah milk masyarakat yang menjadi koloni. Celakanya, benda-benda yang sesungguhnya memiliki nilai yang tidak terkira, kerap kali dilupakan keberadaannya. Sering kita kelabakan ketika salah satu benda warisan nenek moyang kita, atau setidaknya yang memiliki kaitan sejarah kuat dengan kita hilang dan ditemukan di salah satu balai lelang di luar negeri. Entah itu sebelumnya memang sudah berada di luar negeri sebelum entitas negara Indonesia terbentuk atau bahkan setelahnya.

Padahal, di dalam tataran hukum internasional sendiri sejak tahun 1899 telah diakui bahwa benda benda bersejarah milik suatu masyarakat harus dikembalikan ketika masa perang berakhir. Begitupula dengan benda-benda yang memiliki nilai sejarah, religi, maupun kebudayaan tinggi dengan masyarakat setempat. Dimana benda-benda bersejarah ini sejatinya sangat bertalian erat dengan identitas dan praktik-praktik religi maupun kebudayaan suatu masyarakat. Karena tentu, bukan hanya sekedar indah, unik maupun mengesankan namun juga sarat akan nilai-nilai luhur masyarakat pemilik benda-benda bersejarah tersebut, yang tentu berguna bagi generasi kini dan seterusnya. Apalagi secara finansial, benda-benda ini sesungguhnya dapat menghasilkan keuntungan apabila dapat diberdayakan sekaligus dilestarikan, contohnya dengan pameran yang digelar oleh masyarakat pemilik benda tersebut, pengolahan cerita-cerita rakyat yang terinspirasi dari benda tersebut dan tentunya potensi lain yang memungkinkan.

Pemerintah Indonesia dalam urusan ini boleh dibilang bukannya acuh. Beberapa kali sempat terjadi pengembalian benda-benda bersejarah yang dimiliki Indonesia dari Belanda. Pada kurun waktu 1960an hingga 1980an telah terjadi beberapa pengembalian benda benda bersejarah ke Indonesia melalui diplomasi dan negosiasi bilateral antar kedua negara. Hal ini membuktikan, bahwa pengembalian benda-benda bersejarah Indonesia yang berada di luar negeri sangat dimungkinkan terjadi.

Terlebih lagi, sejatinya masyarakat adat di Indonesia telah membentuk komunitas-komunitasnya sendiri jauh sebelum negara indonesia berdiri, melalui masyarakat adat yang terbentuk atas dasar kesamaan ragam budaya, tempat tinggal, keturunan dan beberapa faktor lainnya. Keberadaan masyarakat adat di Indonesia diakui oleh Belanda dan bahkan diikutsertakan di dalam struktur pemerintahan yang ada. Hal ini memungkinkan peluang besar untuk mengklaim benda benda bersejarah kita, karena benda benda ini sejatinya memiliki pemilik yang sah, yang jauh ada sebelum Indonesia merdeka.

Tentunya dengan adanya kemungkinan di atas, sudah selayaknya usaha yang lebih besar mulai dilakukan. Selain karena hukum internasional yang mengatur pun masih ada dan berlaku hingga sekarang. Pengembalian benda-benda bersejarah ini pun tentunya semakin dapat melengkapi kehidupan masyarakat adat di Indonesia. Terlebih lagi, sudah ada beberapa negara yang juga memiliki isu sama, contohnya Australia dan Amerika. Sehingga, sudah pasti Indonesia pun dapat menempuh upaya yang sama untuk dapat mengembalikan benda benda bersejarah milik bangsa Indonesia yang masih tersebar di negara negara lain. Walaupun, kerjasama serta konsolidasi baik dari pihak akademisi maupun praktisi jelas diperlukan. Namun, kajian dan riset komprehensif yang diiringi lobi dan negosiasi antar negara terkait topik pengembalian benda benda bersejarah Indonesia tentunya dapat menjadi buah manis harmonisasi antar disiplin ilmu yang dapat diwariskan. Sehingga generasi mendatang pun masih dapat memahami, serta menghayati kebijaksanaan dan keagungan budaya leluhurnya. Ditambah lagi, dengan adanya benda-benda yang dikembalikan, tentu dapat meningkatkan rasa perhatian dan kecintaan akan budaya asli Indonesia yang diwariskan oleh nenek moyang kita, dan membuat masyarakat Indonesia dapat bersama-sama turut menjaga budaya yang ada.

Oleh karena itu, kerjasama antar semua lini, entah dari kaum sejarawan, pakar hukum, antropologi, arkeologi dan pakar pakar disiplin ilmu lainnya, untuk saling bersama-sama menelusuri kemungkinan kemungkinan lain melakukan klaim atas benda benda bersejarah indonesia yang banyak berada di luar Indonesia menjadi hal yang krusial. Harmonisasi yang ada antar disiplin ilmu tentunya akan membangun usaha yang solid sehingga peluang keberhasilan usaha ini akan semakin tinggi. Dengan harapan kegagalan Indonesia atas Malaysia dalam sengketa Sipadan Ligitan di Mahkamah Internasional karena kurang harmonisnya kerjasama antar disiplin ilmu yang ada, dalam hal pengembalian benda bersejarah milik bangsa Indonesia tidak terulang lagi. Serta dapat mengembalikan benda-benda bersejarah tersebut, kepada pemiliknya yang sah, bangsa Indonesia.
